So all my gear was deleted and if that same thing happened to you ill leave the exact steps for you to replicate to hopefully save your stuff.

Must be still in game BL3 --> hit ctrl alt delete.
Under processes - kill the Epic game store process first (so it doesnt save to cloud when closing BL3)
then kill all BL3 processes
restart and run epic games launcher as administrator -> at that point i redownloaded the patch (3gb)

close epic games launcher -> (backed up my local save file here - just in case - probably does nothing relevant)

restarted/run epic games launcher as admin --> run BL3 --> cloud save/local file problem pops up
!!make sure to download the save from the cloud to local!!

all gear is there.
