Are these copies of Duke Nukem 3D for Sega Genesis legitimate?

Piko Interactive is claiming that they officially got the rights to manufacture and distribute copies of Duke Nukem 3D for Sega Genesis, but I wanted to ask Gearbox to verify these claims.

Keep in mind that there are no copyright and/or trademark listings outside of the usual “Not licensed or endorsed by Sega”.

Gearbox doesn’t own the rights to Duke Nukem 3D. Duke Nukem 3D was developed by 3DRealms and published by GT Interactive Software and originally released on PC in 1996. Gearbox secured the right to Duke Nukem Forever and any potential sequels. That being said, the info in the link you provided looks to be legitimate / plausible based upon what is available on the Duke Nukem 3D Wiki. However, why a company would want to spend the money to bring a 20 year old game to the Sega Genesis now is puzzling at best considering how limited the game is.

Actually, according to the most recent settlement news, Gearbox “is the full and rightful owner of the Duke Nukem franchise.”

I emailed this to Piko Interactive-

"Hi,

I was wondering if the copies of Duke Nukem 3D that you sell for Sega Genesis are officially licensed by Gearbox Software. Thank you."

And I immediately got a response that says this-

So according to Piko Interactive, they deal with 3D Realms for this release, but I’d rather wait for a Gearbox Software employee to give us the final word.

The 4th paragraph (first sentence) of that article reads as follows:

After a teaser site for Mass Destruction appeared, Gearbox sued, asserting full rights to and control over any new Duke Nukem video game.

Duke Nukem 3D is not a new game in the Duke Nukem franchise. Gearbox secured the rights to Duke Nukem Forever and any potential sequels. Piko Interactive is simply porting an existing game that was originally only available on the Sega Genesis in South America. If Gearbox was concerned about what Piko Interactive is doing, lawyers from Gearbox would have served Piko Interactive with a Cease and Desist order.

Yes, but Gearbox also gained the rights to all of the old games as well and that can be seen with the removal of Duke Nukem 3D from digital stores-

3DRealms even said that the Duke Nukem franchise should only belong to one home. And with Gearbox declaring that they are the full and rightful owners to the franchise, as well as them having Duke Nukem 3D (which was published by other companies) taken down and them stating that they will bring the game back later this year, it only makes sense that they own the franchise 100%.
