Gearbox has been dropped from the lawsuit. Sega is still on the chopping block and it looks like its not a class action lawsuit anymore.

This reminds me the ending scene of Robocop 2, when after the rampage of Robocop 2 (Cain) the lead of the OCP goes away with his limo blaming somebody else for the fiasco:

Lewis: That son of a b**ch is getting away with it. We can’t even touch him.
RoboCop: Patience, Lewis. We’re only human.
