My question is, if Miko wears this gear, would Miko get the second perk? Miko does not have a shield, so it can’t actually be depleted, but the shield meter is technically empty. So does this count?

Miko will not get any benefit from the second stat listed unless they are wearing a max shield item as this will then give Miko shields. Why? The Eldrid do not have shields (with the exception of Kelvin) so that means there is no shield to deplete. To bypass this you give them a shield. Before you used to be able to use gear like this with Kelvin and gain benefit from it, but now it has been patched out (I can’t remember if it will still work on him if you give him a shield item - I’ll have to test this).
