Yeah, I got the same automated response as nolic. Asked them to answer the question, didn’t reply. I’m going for it. Going to post the first episode tomorrow, wait a few days, and if I don’t get flagged, I’ll keep posting. Slowly. If anyone gets a copywright strike, share here!

Be mindful that copywright claims can take a few days, or even weeks to come through, so don’t upload too many videos within the first week or two,. I’m glad I finally found someone who sees this game for more than simply its gameplay mechanics. I, too, am absolutely loving it. My channel is TheTechnicalNirl. I’ll be uploading saturday, tomorrow, at 5pm gmt. I haven’t watched yours yet because I really need to go through this alone. The game has a special place in my heart, it’s sort of my moment. I’ll be watching playthroughs after I’m finished with mine =)

Any developments on this front?

I made sure I stated that the title of the song is not “Agnus Dei, Op. 11”, but rather that it is an independent execution of “Adagio for Strings”, as well as that I am not, nor do I intend to, monetize the content. I also stated that it is Gearbox that holds the rights to this song, although I find it highly unlikely. Neither Gearbox, nor Studio X Labs has mentioned who is the true copyright owner, even after some insistence on my part. I don’t know how well this will hold for other episodes, but my second one is coming out tomorrow, with original lore read from the original instruction manual! Be strong, fellow creators, and dispute fraudulent claims!

So I received a response from Gearbox regarding YouTube monetisation. Here it is for everyone that’s interested:

We greatly appreciate fan efforts like this, though we don’t make a
practice of offering formal approvals and endorsements. Our experience
has been that everyone has more fun when independent efforts remain
independent.
From what I’ve seen, our lawyers tend to be okay with videos and streams
so long as they’re not disrespectful, offensive or damaging to our own
business interests (including no monetization) …once that happens, it’s
definitely game over. But people who tread appropriately are usually
okay!

As you can see, it seems that we’re fine to create content and upload within their guidelines but monetisation is a no-go sadly. :worried:

If someone was fortunate to get a HWR video viral, then maybe I could see the issue if said video earned a lot of money for the uploader, but the vast majority are probably going to earn nothing more than a couple of bucks off the content, hardly anything that would be damaging to Gearbox’s business interests.

However, if the uploader was just simply uploading “non-commentated” content, then I’d probably take issue with that, since that’s not transformative: adding a voice over would make it transformative for monetisation (YouTube is quite clear that pure gameplay cannot be monetised, so it has to include a voice over)

Hmmm… Well that seems like it’s pretty clearly saying no monetisation… But like @SuperSajuuk said doesn’t seem like it’s going to be damaging to their business interest to monetize… Maybe if the video was saying something like “these guys are terrible don’t buy the game” or if somehow millions upon millions of people aren’t buying the game but are watching videos instead…idk…but I highly doubt let’s plays are going to do this. Idk…

Exactly. Unless the video had tons of views and was profoundly negative and the uploader earned a lot of money off a negative review, nothing would damage Gearbox at all. In fact, it would just strengthen the company and get them more money from sales.

I don’t see how allowing people to monetise is going to damage them: it’s all on a case-by-case basis and let’s plays will definitely not damage Gearbox.

Adding voiceovers doesn’t exempt you from a content owner’s monetisation restrictions, it simply allows you to upload a video without it being at risk of receiving a copyright claim as long as you aren’t monetising the content.

I’ve sent Gearbox another message to get clarification on what they view as being damaging to their business but “including no monetization” in their own words seems pretty clear to me.
